Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of the commute services provided by Simply Commute, referred to herein as "the Company," "we," "our," or "us," to passengers ("you," "your"). By booking or using our shuttle services, you agree to abide by these terms.


Service Description

The Company provides commute services between designated pick-up locations within Celina, McKinney, Prosper, and Frisco cities and drop-off at Westlake Business Park. The shuttle service operates according to a set schedule, subject to availability, and is not a private or chartered transportation service unless otherwise specified.

Membership

  • Memberships are required in advance to avail of our services. Membership can be purchased via our website www.simplycommute.com
  • All memberships are subject to availability. We recommend booking at least 24 hours in advance.
  • To complete a membership purchase, you must provide accurate information, including your name, contact details, and city.
  • You may modify or cancel your membership by calling or emailing us before your next renewal date.

Payment

  • All payments must be made in full at the time of purchasing membership.
  • We accept payments via PayPal only at this time.
  • Prices for services are subject to change, and any such changes will be communicated in advance.
  • If all eligible payment methods we have on file for you are declined for payment of your membership fee, you must provide us with a new eligible payment method promptly or your membership will be canceled. Suppose you provide us with a new eligible payment method and are successfully charged. In that case, your new membership period will be based on the original renewal date and not the date of the successful charge.
  • UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.

Passenger Responsibilities

  • You are responsible for arriving at the designated pick-up point at least 10 minutes before the scheduled departure time.
  • Passengers must follow all safety instructions provided by the driver, including wearing seat belts and refraining from any disruptive behavior.
  • Passengers are not allowed to carry illegal substances, dangerous items, or animals (unless previously agreed upon, such as for service animals).
  • Any damage to the vehicle or misconduct that results in additional charges will be the responsibility of the passenger.

Liability and Insurance

  • The Company maintains appropriate liability insurance for its vehicles, but passengers are responsible for their personal belongings.
  • We are not liable for any delays, accidents, or damage to personal property unless caused by our negligence or breach of this Agreement.
  • The Company is not responsible for any injuries, delays, or cancellations resulting from circumstances beyond our control, including but not limited to traffic, weather conditions, accidents, or mechanical failure.

Delays and Cancellations

  • While we strive to maintain an on-time schedule, we cannot guarantee arrival or departure times due to external factors like traffic and weather.
  • In case of significant delays or cancellations initiated by the Company, we will make reasonable efforts to notify you and offer alternative transport solutions.
  • If the passenger fails to show up for their scheduled ride, no refund will be issued, unless specified otherwise.

Code of Conduct

  • Passengers are expected to behave respectfully and courteously towards other passengers and the driver.
  • Any passenger exhibiting disruptive, abusive, or dangerous behavior may be removed from the vehicle and may not be eligible for a refund.
  • Smoking, alcohol consumption, or using drugs is prohibited on the shuttle.

Privacy Policy

  • The Company collects personal data (such as name, contact information, and payment details) to facilitate your booking and provide our services.
  • We respect your privacy and will not share your personal information with third parties without your consent, except as required by law.

Force Majeure

The Company is not responsible for any delays, cancellations, or failure to provide services due to circumstances beyond our control, including but not limited to natural disasters, civil disturbances, pandemics, strikes, or other force majeure events.

Modifications to Terms

  • The Company reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to passengers via email, our website, or other appropriate channels.
  • The updated Terms will take effect immediately upon posting, and your continued use of our service will signify your acceptance of the revised Terms.
